It’s Not Wrong to File a Lawsuit

Most Personal Injury Claims Never Go to Trial

Nearly 96% of all personal injury claims never make it to trial. In fact, there’s a joke that goes like this: what does a lawyer call it when a car accident case goes to jury trial? A big mistake.

There’s a reason that both defense and plaintiff attorneys feel this way. First, lawyers, even the toughest of them, consider trials as a last resort. Neither side would like to go to trial, and both sides will seek to avoid it if possible. This is because you can never know how the jury will act or what they will be thinking. They are an unknown quantity, and they are unpredictable. For example, if a recent personal injury case that settled for an outrageous sum of money has been in the news, the jurors might think that the person who’s been injured is just faking it and after the big bucks. Simply put, neither the insurance defense lawyer nor the lawyer for the injured person has control to choose the jury pool. They must work with what they are given and can only strike so many potential jurors. Additionally, trials take a significant amount of time and resources, and most of the time, attorneys and insurance companies can effectively negotiate a compensation settlement package that both they and you as the injured person can agree on.

This negotiation is often effective and avoids a trial because most attorneys and insurers understand the value of your case. They know this because they have looked at other instances of personal injury claims in which the person had injuries like yours. Your attorney will have the know-how and experience to analyze your case and help you understand the potential compensation you may hope to obtain for costs such as medical expenses, repair of damaged vehicles, and pain and suffering.

Trials are extremely stressful on the injured person. This is something that you must indeed take into consideration. You don’t want to go through a trial that is going to cost you your health and emotional well-being no matter how much you have been wronged.
